About the Opportunity
We are conducting a confidential search for an experienced Marketing Law Attorney to join a sophisticated U.S. law firm serving enterprise and consumer-facing clients.
This opportunity is ideal for an attorney with strong experience in marketing and advertising law, consumer-facing legal matters, commercial transactions, and client counseling who enjoys providing practical, business-oriented legal advice.
Depending on experience and quality of work product, the position may be structured as Senior Associate, Counsel, or Partner.
The role is fully remote, with flexible full-time or part-time options.
Key Responsibilities
- Advise clients on marketing, advertising, promotions, and consumer-facing legal matters.
- Review advertising campaigns, claims, substantiation, disclosures, disclaimers, and promotional materials.
- Advise on digital and social media marketing, email and SMS marketing, influencer programs, sponsorships, and branded content.
- Handle legal matters involving sweepstakes, contests, loyalty programs, rewards programs, and consumer promotions.
- Draft, review, and negotiate marketing agency, influencer, talent, sponsorship, production, and advertising agreements.
- Advise on websites, applications, consumer-facing terms, disclosures, and marketing technology.
- Identify legal issues involving consumer protection, privacy, intellectual property, technology, and advertising compliance.
- Draft and negotiate commercial and technology agreements.
- Advise clients on key provisions including indemnification, limitation of liability, warranties, insurance, confidentiality, IP, and data security.
- Provide practical legal advice that balances legal risk with business objectives.
- Work directly with sophisticated clients, in-house legal teams, marketing teams, technology teams, and business leaders.
Requirements
- 5+ years of full-time experience specifically practicing Marketing, Advertising, Consumer, or closely related transactional law.
- Significant experience handling marketing, advertising, promotions, consumer-facing, or commercial legal matters.
- Strong contract drafting and negotiation skills.
- Strong client counseling and communication skills.
- Ability to understand business objectives and provide practical, actionable legal advice.
- Experience working with sophisticated enterprise clients, consumer brands, in-house legal teams, agencies, or technology companies.
- Ability to independently manage multiple legal matters and priorities.
- Excellent attention to detail and strong legal judgment.
- Strong ownership, accountability, and follow-through.
- Ability to work effectively in a fully remote and highly autonomous environment.
- Active license to practice law in at least one U.S. jurisdiction.
- J.D. from a Top 60 U.S. law school OR graduation within the Top 20% of the class.
Preferred Qualifications
- Experience working with enterprise in-house legal departments.
- Experience as a seconded or embedded legal resource.
- Experience advising sophisticated consumer-facing brands.
- Experience at the intersection of marketing and data privacy.
- Experience with technology transactions, SaaS, MarTech, or digital platforms.
- Experience with advertising technology, influencer marketing, digital media, or consumer promotions.
- CIPP/US or CIPP/E certification.
- Experience mentoring, hiring, onboarding, or training other attorneys.

Requirements

- 5+ years of full-time experience specifically practicing Marketing, Advertising, Consumer, or closely related transactional law.
- Active license to practice law in at least one U.S. jurisdiction.
- Significant experience advising clients on marketing, advertising, promotions, and consumer-facing legal matters.
- Strong experience with commercial contract drafting, review, and negotiation.
- Experience handling advertising and marketing agreements, including agency, influencer, talent, sponsorship, production, or insertion-order agreements.
- Strong understanding of digital marketing, social media, email/SMS marketing, influencer marketing, and consumer promotions.
- Experience advising on legal issues involving consumer protection, privacy, intellectual property, technology, and advertising compliance.
- Strong client counseling and business judgment skills, with the ability to translate legal requirements into practical, business-oriented solutions.
- Ability to independently manage complex matters, prioritize multiple clients, and work effectively in a fully remote environment.
