Litigation Attorney - Professional Liability/D&O

Our Staff Counsel is seeking an Attorney licensed and residing in Texas, to join a  legal team committed to excellence, collaboration, and professional integrity. Position Overview:

As a member of our Texas Staff Counsel group, this attorney will be primarily responsible for handling the defense of claims made against companies in professional liability disputes, D&O matters, Real Estate/title issues and litigation, HOA litigation, and general liability matters. This attorney will be responsible for responding to demand letters, state and federal agency charges, subpoenas, and lawsuits which have been filed against Hanover’s insureds. This attorney will also be responsible for investigation and management of assigned cases from the inception of the lawsuit until conclusion through dismissal, settlement, or trial, and working with adjusters and insureds to resolve claims as expeditiously and efficiently as possible.

Hanover offers flexible work arrangements, and this role can be performed remotely, in-office, or hybrid.  

In this role you will:

• Handles a caseload which includes defending Hanover’s insureds in connection with pre-litigation and litigated disputes in the areas of general liability, real estate/title issues, HOA, D&O, and miscellaneous professional liability. 

• Independently conducts depositions, pre-trial discovery, mediations, arbitrations, trials, or any other legal activity required to resolve cases.
• Frequent communications with claim professionals and clients concerning the status of and evaluations of legal files.
• Provides legal advice to insureds and claim professionals concerning the matter.
• Negotiates settlements as directed.
• Attends round tables.

What you need to apply:

• Must be licensed to practice law in the state and federal courts in Texas.
• 10+ years’ experience in civil litigation, with defense experience preferred.
• Trial experience desired.
• Must have a strong knowledge of current procedural and substantive law, as well as federal, state, and administrative agency rules.
• Must demonstrate an ability to analyze issues, pro-actively develop effective strategies on pending cases, communicate regularly with claims professionals, document communications, and resolve cases as efficiently and effectively as possible.
• Must have solid experience in preparing responsive pleadings, handling appearances, motion practice, and valuation of claims, settlement and trials.
• Must be willing to work independently with minimal direction, handle matters efficiently, and be willing to travel as necessary for court hearings, depositions, site inspections, client meetings, and other in-person events.
• While flexible work arrangements are available, this position requires travel and personal appearance (as required) in order to attend hearings, conferences, mediations, arbitrations, depositions, and/or trial.

Compensation:

The target hiring range for this role may vary based on geographic location and other factors, including merit or performance, demonstrated proficiency, skills for the role, education, travel requirements, and experience. Additional compensation may include an annual bonus (which could take the form of a general bonus, sales incentive, or short-term incentive), long-term incentive or spot recognition awards. The posted range reflects our ability to hire at different position titles and levels depending on background and experience.
