Job Description

Our client is looking to enhance its Compliance Management System ("CMS") and compliance department to further ensure compliance with mortgage-related federal, state, NMLS, CFPB and related regulations. Confidential search for a senior, experienced lending, servicing, loss mitigation, and/or default compliance leader and self-starter to oversee the expansion and implementation of our client's Compliance program.

Critical Responsibility: Design and implement and manage a quality Compliance Management System (CMS)

Responsibilities:

  • Develop and maintain policies and procedures to ensure compliance with state, federal, NMLS, CFPB and related regulatory guidelines
  • Oversee acquisition and maintenance of company federal, state, and regional licenses
  • Oversee external sub-servicers to ensure their compliance with all relevant regulations and client policies
  • Monitor and oversee employee training, NMLS and related license maintenance, and compliance
  • Manage compliance quality control including regular testing of asset management, origination, and servicer activity to ensure adherence to policies, identify and escalate issues to management and the board, and assist in implementation and testing of any remediation
  • Act as primary liaison for any servicer or client regulatory examinations
  • Oversee regulatory submissions, review findings, communicate results, and supervise implementation/testing of any corrective actions
  • Conduct and/or coordinate regular servicer reviews and annual USAP audits, and monitor and coordinate with servicers on their regulatory examinations
  • Monitor for changes in applicable laws and regulations, assist in identifying, interpreting, and applying regulatory and compliance requirements, and advise senior management on development and implementation of business controls to mitigate key compliance risks
  • Apply professional judgment to develop a practical program balancing an appropriate level of risk against business needs
  • Identify and analyze risks including but not limited to complaints, vendors, process, and system weaknesses, and testing to obtain a holistic view of regulatory risks

Qualifications:

  • 10+ years of compliance experience in residential mortgage lending or servicing for a mortgage broker or lender, mortgage investment company, REIT, bank, or credit union
  • Extensive knowledge of federal and state laws impacting mortgage origination and servicing, including but not limited to: Dodd-Frank and CFPB oversight environment, HMDA, Privacy, Fair Credit Reporting, Flood Insurance, AML, OFAC, TILA, ECOA, FCRA, RESPA, Fair Housing Act, Homeowners Protection Act, and predatory lending laws
  • Significant experience with distressed or non-performing (NPL) mortgages preferred
  • Experience drafting and maintaining (change management) policies and procedures and interaction with executive and board level management is highly desired
  • High degree of professional ethics and integrity is essential
  • JD (Juris Doctor) and/or CRCM (Certified Regulatory Compliance Manager) preferred
  • Familiarity with GSE, VA, and HUD (FHA) investor and insurer requirements
  • Excellent interpersonal, oral, and written communication skills including superior policy drafting skills
  • Excellent teamwork, organizational, analytical, and creative problem-solving skills, personal commitment to quality
  • Ability to prioritize and to multi-task in a fast-paced environment
  • Ability to handle confidential information in a discreet, professional manner
